SCL Hire & Sales: Returns & Trading Terms

 

1. Scope of These Terms

 

1.1 These Terms apply to all equipment hire, product sales, and related services ("Goods/Services") provided by SCL Hire & Sales (“SCL”, “we”, “us”) to trade customers (“Customer”, “you”).

1.2 If you are a private consumer, certain statutory rights apply under UK law, which supersede parts of this policy.

2. Order Acceptance & Contracts

 

2.1 All orders are subject to availability at the time of acceptance.

2.2 A contract is formed only when SCL confirms your order in writing or dispatches the goods.

2.3 We reserve the right to withdraw, amend, or resile from any quotation or order before acceptance.

3. Prices & Payment

 

3.1 Prices are as quoted on our website or in written estimates and exclude VAT.

3.2 Payment is due within 30 days of invoice unless otherwise agreed in writing.

3.3 Late payments will accrue interest and fees at the higher of the statutory rate or 4% above the Bank of England base rate, per annum, compounded daily.

3.4 We may require deposits for hire items or prepaid purchases.

 

4. Hire Period & Returns

 

4.1 The hire period starts from the date the goods leave our control and ends upon their return in satisfactory condition.

4.2 You are responsible for safe return, clean condition, and all accessories. Fair wear and tear is permitted.

4.3 Goods must be returned on or before the agreed date; late returns incur additional charges.

 

5. Delivery & Collection Services

 

5.1 You may collect goods from our premises, or request delivery/collection at our standard rates.

5.2 Collection requests should be made at least 3 working days before the end of the hire period.

5.3 You remain responsible for the goods until they are in our physical possession.

 

6. Risk & Title

 

6.1 Risk transfers to you on delivery or collection and remains until goods are returned.

6.2 Title to sold goods remains with SCL until full payment is received. For hire equipment, title remains always with us.

 

7. Damage, Loss & Repairs

 

7.1 You must ensure goods are used properly and maintained.

7.2 Damage beyond fair wear and tear, loss, or theft will result in charges covering repair or replacement.

7.3 If equipment breaks down through no fault of yours, report it immediately. We will repair or replace as soon as practicable.

 

8. Cancellations & Returns (Sale Goods)

 

8.1 When purchasing, you may cancel within 14 days of receipt (as per UK Consumer Contracts Regulations) — items must be returned in original condition.

8.2 Refunds are processed within 14 days of receipt and inspection of returned goods.

9. Liability & Insurance

 

9.1 We maintain insurance covering the equipment, but you may be required to insure high-value items used on your site.

9.2 Our liability is limited to the cost of hire or sale, not to exceed the invoice value—except for personal injury or death resulting from our negligence or breach of statutory duty.

 

10. Warranty & Complaints

 

10.1 Any defects or shortages must be notified within 48 hours of delivery.

10.2 We reserve the right to inspect and replace or repair faulty goods.

11. Cancellation by SCL

 

11.1 We may cancel orders due to stock issues, errors, or regulatory reasons — in these events, any deposit or payment will be promptly refunded.

 

12. Force Majeure

 

12.1 We are not liable for failure or delay caused by events beyond reasonable control (e.g., weather, strikes, supply chain disruptions).

 

13. Data & Privacy

 

13.1 Customer data is processed in accordance with our Privacy & Cookie Policy.

 

14. Variations & Governing Law

 

14.1 These Terms may only be amended in writing by an authorised SCL Director.

14.2 These Terms are governed by and interpreted under English law. Any disputes shall be subject to the jurisdiction of the English courts.
